Terms of Acceptable Use

XPIN Network eSIM Products and Services ("Services") are provided by XPIN Network, conducting business as XPIN Network ("XPIN," "XPIN Network," "we," "our"). XPIN Network reserves the right to periodically review the usage levels of the XPIN eSIM service plans ("XPIN Network Services" or "Services"), including data usage, to ensure that you are not using the Services in a manner that we consider to be in violation of this Acceptable Use Policy ("Policy"). Should any such abuse or violation be discovered, we reserve the right to terminate or adjust the plan at our sole discretion. Furthermore, for users we determine, in our sole discretion, to have violated this Policy, we may terminate their services until we are satisfied that the user is no longer in violation of this Policy. You agree to use the data portion of your Services for traditional web browsing, messaging, and similar activities on your device, and will not employ methods, devices, or procedures to exploit the Services through excessive use of the plan or in a manner not intended by XPIN Network, in violation of any of the prohibitions set out above or below. If XPIN Network, at its sole discretion, determines that your use of the Services violates any of these prohibitions or is otherwise "unreasonable" or results in the abuse of the Services, XPIN Network may terminate your Services or modify your Services. You agree to comply with this Policy as a condition of your use of XPIN eSIM Services. If you do not agree to comply with this Policy, please refrain from using XPIN eSIM Services. This Policy supplements any other applicable usage terms contained within the XPIN Network Terms and Conditions.
Prohibited Activities
You agree to use the XPIN eSIM Services for lawful, proper, and appropriate purposes. XPIN Network prohibits the use of any XPIN eSIM Services for unreasonable, improper, illegal, fraudulent, threatening, or abusive activities.The following is a non-exhaustive list of examples that XPIN Network, at its sole discretion, considers to be unreasonable, abusive, or otherwise illegal, improper, or inappropriate, and which may be subject to termination or adjustment:
Social media marketing, advertising, or commercial solicitation (including charitable or political solicitation or polling).
Reselling, rebranding, resupplying, remarketing, or commercial exploitation of the XPIN eSIM Services.
Fraudulent activities.
Hindering other customers' access to the wireless network.
Compromising network security or capacity.
Excessively and/or disproportionately causing network congestion.
Usage that adversely affects network service levels or legitimate data flows.
Usage that degrades network performance.
Usage that causes harm to the network or other customers.
Automated sending of text or picture messages.
Uploading, downloading, or streaming continuous video or audio.
"Spamming" or engaging in other abusive or unsolicited communications, or any other mass, automated voice or data communications for commercial or marketing purposes.
Interfering with our ability to provide the services to you or other subscribers.
Using the Services to threaten, abuse, harass, defame, or deceive.
Using the Services to impersonate others, send bulk messages, use bots, data mining techniques, or other automated devices or programs to catalog, download, store, or otherwise copy or distribute information from our Services, or using any automated means to manipulate our Services.
Using the Services to transmit or receive any communications or materials that may constitute a criminal offense, give rise to civil liability, or otherwise violate any applicable local, state, national, or international laws, or to encourage conduct that constitutes a criminal offense, gives rise to civil liability, or otherwise violates any applicable local, state, national, or international laws.
Violating any laws, regulations, or ordinances.
Infringing upon any third party's intellectual property or personal rights.
Using the Services to access or attempt to access information, accounts, or devices of others without authorization, or to infiltrate or attempt to infiltrate the networks or systems of XPIN Network or its network providers.
Using the Services to generate or disseminate viruses, malware, or "denial of service" attacks.
Non-Transfer of Services
You shall not resell or transfer your XPIN eSIM Services or the provision of data services to any other person through the use of your XPIN eSIM Services or the functionalities of the XPIN eSIM Services.
Accessibility Provision
Notwithstanding any provision to the contrary in this Policy, the use of XPIN eSIM Services by customers with accessibility needs does not violate this Policy if it employs industry-standard accessibility technologies and solutions, and such use does not constitute a prohibited use of the XPIN eSIM Services (e.g., for illegal purposes).
Right to Terminate
In addition to any other rights to terminate services, if XPIN Network, at its sole discretion, determines that you have violated any of the restrictions mentioned above, XPIN Network reserves the right to immediately terminate the service without notice, holding you responsible for all charges, including but not limited to any unbilled charges, all of which are immediately due.During the review of conduct that may violate this Policy, XPIN Network may suspend one or more accounts involved and/or block message transmission that may violate this Policy. If we have reason to suspect a violation of this Policy, we may cooperate with: (i) law enforcement agencies investigating suspected illegal activities, and (ii) other network or facility providers to enforce this Policy. After the termination of your service account, XPIN Network has the right to delete any messages and communications associated with your account (as well as any auxiliary lines associated with your account). The failure of XPIN Network or its suppliers to enforce this Policy for any reason shall not be construed as a waiver of any right to do so at any time. You agree that if any part of this Policy is determined to be invalid or unenforceable, that part will be interpreted to the extent possible in accordance with applicable law, and the remaining parts will remain in full force and effect.
Monitoring
XPIN Network does not monitor the web browsing history or message conversations of its subscribers to enforce this Policy.We may monitor the use of XPIN eSIM Services to detect violations of this Policy and other materials that constitute your agreement with us. If we suspect a violation of this Policy or any other materials that constitute your agreement with us, or if we believe it is necessary to protect our services, XPIN Network or its network providers and/or their respective parent companies, affiliates, directors, officers, agents, and employees from harm, we may remove or block all communications without any liability.
Service Theft
You shall not use or obtain our services in any manner that circumvents the policies and procedures of XPIN Network. If you believe that your service has been stolen, fraudulently used, or otherwise used without authorization, you must immediately notify us in writing. When you notify us of any such incident, you must provide your account number and a detailed description of the circumstances of the theft, fraudulent use, or unauthorized use of the service. Failure to notify us promptly in writing may result in the disconnection of your service and additional charges to you. Until you have notified us in writing, you will remain responsible for all use of the stolen services and any and all acts of theft, fraud, or unauthorized use prior to the date XPIN Network receives the notification.
Providing Information to Authorities and Third Parties
If we believe that you have used the XPIN Network services for illegal purposes, we may forward the relevant communications and other information (including your identity) to the appropriate authorities for investigation and prosecution. You agree that we may forward any such communications and information to these authorities. Additionally, we may disclose your name, payment information, and other personal information, any communications you send or receive, and any other information we may have about your account, including but not limited to the type of service, duration of service, MAC address, IP address, email address, and all other account information, as follows: in response to requests from law enforcement or other government agencies; as required by law, regulation, rule, subpoena, search warrant, or court order; when necessary to identify, contact, or take legal action against someone who may be abusing the service; to protect the rights and property of XPIN Network; or in emergency situations where such disclosure is necessary to protect XPIN Network customers or third parties from imminent harm.
Your Obligations
You and all users associated with your XPIN Network account and the XPIN eSIM services connected to it must comply with this Policy. If you or any user of the XPIN eSIM services under your account fail to adhere to this Policy, XPIN Network reserves the right to suspend or terminate your XPIN eSIM services. You are legally and financially responsible for all activities on your XPIN Network account and all devices connected to it, including those of friends, family, or other individuals with access to your service. You are also responsible for securing any mobile devices you use to access the services.
Updates to This Policy
XPIN Network may periodically revise this Policy by posting a new version on the XPIN Network website or mobile application. Please check the XPIN website and mobile application regularly for updates.
